What Kind of Snake is This???

UPDATE: This is a garter snake. What a dork I am.

I'm a little freaked out to think this might be a poisonous snake that is next to the house!!! If you know what it is, please email me or post a reply! It's not a black snake. My sister told me is was a water mockasin - but I've never seen a mock like this one!
